Trademarks are a way for customers to identify the source of products and services. Trademarks identify a product and distinguish it from products created by others. The process to register a trademark in Australia is managed by IP Australia.

IP Australia is the Australian government agency responsible for:

  • patents
  • trademarks
  • designs
  • plant breeder’s rights.

They employ examiners who are skilled in all technical fields to assess applications.

A trademark can be a:

  • word
  • name
  • symbol
  • device
  • colour
  • shape
  • sound
  • movement
  • scent

or combination of these.

Trademarks are used to identify and distinguish the goods of one manufacturer or seller from those manufactured or sold by others. It also indicates the source of the goods.

Trademarks can be used unregistered (™) or registered (®).

Before using a trademark, you need to check that someone else doesn’t already have legal rights.
